The night you are actually arrested, the officer may or may not take you to jail. If you are polite and respectful, he probably will not take you to jail. Some officers have threatened to take an individual to jail if they do not blow into the breathalyzer. The consequences of blowing into the breathalyzer could be many times worse than going down to jail and being released later that night.
After you plead guilty or are found guilty at trial, the statute calls for an incarceration. Probably 98 percent of the time you are going to be going to a three driver’s intervention program as opposed to three days in jail.
