DUI Arrest Lawyers in Ohio
Most of the time the answer to this question will be a resounding no.
In almost all DUI stops, an officer will issue a ticket for the DUI violation and for the traffic violation which gave them probable cause, or reason, to stop you. Sometimes if an individual is charged with ORC 4511.19 (A)(i)(f) and (A)(i)(g), the section of the DUI Statute that deals with blood, a ticket is not immediately written.
In some cases, the officers won’t write the ticket for the blood test on the night that the test was given, but you still have been charged with a DUI. You just won’t receive the actual written ticket until that blood test comes back.
Regardless, if you’ve been stopped and questioned about a DUI, you’re likely nervous, even if you didn’t get charged. It shakes you up and you’re likely to drive away with more than one other question:
Why wasn’t I charged with a DUI? Should I have taken the breath test? Will they put this on my driving record?
